Terms & Conditions
Last updated:
These Terms & Conditions apply to quotes, orders, products and services supplied by DEEP EARTH COLLECTIVE LIMITED, trading as Whenua Printing (“we”, “us” or “our”).
Please read these Terms before accepting a quote or placing an order.
1. Quotes and order acceptance
Website prices are indicative unless expressly stated otherwise. A website enquiry or request for a quote does not confirm an order.
Our written quote identifies the products, specifications, quantity, price and relevant delivery arrangements.
Unless another period is stated, quotes remain valid for seven calendar days from the date of issue.
Your order is confirmed when we accept it in writing. Please check the confirmation and notify us promptly of any discrepancy.
If you place an order on behalf of a business or another person, you confirm that you have authority to act for them.
2. Prices and payment
All prices are in New Zealand dollars (NZD).
Your written quote will show the total payable, including any applicable GST, delivery and mandatory charges.
Unless we agree otherwise in writing, full payment and written artwork approval are required before production begins.
Any payment required for design, artwork preparation or other preliminary work will be explained and agreed before that work starts.
Customer-requested changes may require a revised quote. We will obtain your agreement before carrying out additional chargeable work.
If an undisputed payment becomes overdue, we may pause work after giving reasonable notice and an opportunity to resolve the outstanding payment. Delayed payment or approval may affect the production and delivery schedule.
3. Price Beat Promise
3.1 Eligible products
Our Price Beat Promise applies to standard business cards, flyers and pull-up banners within the product specifications and quantities we currently offer.
It does not automatically apply to other products or services.
Design, copywriting, installation, rush services, branded merchandise, corporate gifts and non-standard projects are outside this promise unless we expressly include them in writing before you order.
3.2 When to apply
You must submit your request before accepting our quote, confirming your order or making payment for that order.
The promise does not provide retrospective price adjustments solely because another price becomes available after your order has been confirmed.
3.3 Eligible competitor offers
The competitor must be a genuine printing business operating in New Zealand and able to supply the quoted order to the required New Zealand delivery address.
Their offer must be:
- A genuine, current written quote or verifiable firm offer.
- Available for you to accept when you submit your request.
- For the same eligible products and quantity.
- Based on matching specifications and objectively comparable quality.
- Able to meet the same required delivery deadline.
- Based on equivalent payment and purchasing conditions.
Relevant specifications include dimensions, paper or material grade, paper weight, printed sides, colour requirements, finishing, lamination and any included stands, hardware or accessories.
Similar product names alone do not establish a valid comparison.
3.4 How prices are compared
We compare the total amount payable for the equivalent eligible order, including:
- The printing and product price.
- Any applicable GST.
- Setup and mandatory production charges.
- Required hardware or accessories.
- Delivery to the same destination.
- Any other unavoidable charges.
A lower printing price that results in a higher total payable does not qualify.
Prices for different quantities, materially different specifications or different delivery requirements must be adjusted to a genuinely comparable basis before a comparison can be made.
Where an offer includes additional products or services, we may reasonably require an itemised quote to identify the comparable eligible order.
3.5 Evidence required
Please email Whenuaprinting@gmail.com with the competitor’s quote, offer details or supporting link.
The information must allow us to identify:
- The competitor.
- The offer date and validity.
- The product specifications and quantity.
- The total payable and included charges.
- The payment and delivery conditions.
You may redact unrelated personal or confidential information, provided the offer remains verifiable.
We may request clarification reasonably necessary to assess eligibility. If the information remains insufficient, we will explain what is missing rather than treating the offer as verified.
3.6 Offers that do not qualify
The promise does not apply to:
- Fabricated, materially altered or fictitious quotes.
- Expired offers or prices not available for you to accept when you apply.
- Obvious pricing errors.
- Unconfirmed estimates or indicative “from” prices.
- Offers with materially different specifications, quantities or service requirements.
- Conditional offers where you do not meet the purchasing conditions.
- Used, damaged, liquidation or clearance goods that are not comparable to the new products being ordered.
We will assess requests against these stated conditions. If a request does not qualify, we will explain the relevant reason.
3.7 The price-beaten quote
If a qualifying competitor’s total is lower than our quoted total, we will issue a written quote with a lower total price.
The promise provides a lower total quote. It does not offer a fixed percentage reduction unless we expressly advertise one.
If our quoted total is already lower than the qualifying competitor’s total, no further reduction is required under this promise.
Price beating applies to the comparable order total. Discounts are not multiplied by the number of items or added together across successive comparisons.
Other discounts, vouchers or promotions are not automatically added on top of a price-beaten quote.
The revised quote will state its validity period. Changes to the specifications, quantity or delivery requirements require reassessment and may result in a new quote.
4. Artwork requirements and approval
Please provide artwork suitable for the agreed printing specifications.
Unless separately agreed, our artwork checks concern production suitability and do not include comprehensive proofreading, factual verification or legal review.
Before approving artwork, you must check all wording, names, contact details, dates, prices, dimensions, images, layout and other content important to your order.
Approval must be given by email or another agreed written channel.
If we accurately reproduce content you supplied and approved, changes or reprinting to correct that content may involve additional charges. We will confirm those charges before proceeding.
Approval does not remove our responsibility for our own errors, failure to follow the approved specifications or obligations under applicable law.
5. Materials, colours and production specifications
Screen colours may differ from printed colours. Materials and finishes can also affect appearance.
If precise colour matching or a particular material is essential, tell us before confirming the order. Any agreed proofing, colour-matching service or additional charge will be recorded in the quote.
Any production tolerances affecting your order will be explained before acceptance. We will not substitute materially different specifications without your agreement.
Website images and mock-ups illustrate examples. Your written quote and approved specifications identify the products being ordered.
6. Production and delivery
We will confirm the estimated production and delivery timeframe for your order.
If you require delivery for an event or a specific date, tell us before ordering so we can confirm whether we can agree to that deadline.
Delays in payment, artwork approval or customer-supplied information may affect scheduling. We will communicate any resulting changes.
If another delay arises, we will notify you as soon as reasonably practicable and discuss practical options.
You are responsible for providing accurate delivery details and relevant access instructions. Additional delivery costs arising from incorrect information or customer-requested changes will be explained before being charged.
For deliveries arranged by us, contact us about missing, delayed or damaged goods. We will follow up with the relevant provider and address our responsibilities under the order and applicable law.
If events outside our reasonable control disrupt fulfilment, we will take reasonable steps to minimise the impact and discuss an appropriate resolution. This does not remove rights or remedies available under applicable law.
7. Changes and cancellations
Contact us immediately if you need to change or cancel an order.
We will check its progress and explain what remains possible, including any effect on price or delivery.
Changes may not be possible once printing or customised production has begun.
For a change-of-mind cancellation that we agree to accept, any cancellation charge will reflect:
- Reasonable work already completed.
- Costs committed specifically to your order that we cannot reasonably recover.
- A deduction for costs saved because of the cancellation.
We will explain the calculation and refund any remaining prepaid balance.
Completed customised goods made to the agreed specifications are not automatically eligible for return or refund because you change your mind.
These provisions do not limit cancellation or refund rights arising from our failure to fulfil the order or from applicable law.
8. Quality issues and remedies
Please report an issue as soon as reasonably possible, with your order details, a description and photographs where helpful.
Retain the goods and packaging where reasonably practicable so we can assess the issue.
We may investigate the cause before determining the appropriate remedy.
Where we are responsible, we will provide an appropriate remedy, which may include correction, reprinting, replacement or a refund, depending on the circumstances and your legal rights.
We will cover reasonable costs of providing a remedy that is our responsibility, including necessary return freight.
Our request for prompt notification does not shorten any statutory rights or applicable claim periods.
9. Artwork rights and lawful use
Ownership of materials you supply remains with you or the relevant rights holder.
You confirm that you have the rights or permission necessary for us to reproduce those materials for your order.
You authorise us to reproduce the materials, make agreed production adjustments and provide relevant files to authorised service providers as reasonably necessary to fulfil the order.
We may pause work where reasonably necessary to investigate a credible concern about unlawful content or infringement. We will notify you promptly and discuss the appropriate next steps.
Any ownership or licensing arrangements for original design work created by us will be agreed before that work begins.
10. Scope of our services
Our agreed deliverables are the products and services described in your quote and order confirmation.
Unless expressly agreed, our services do not include campaign management or a promise of particular sales, enquiries, event attendance or marketing returns.
This description of our service scope does not exclude responsibility for our own breach of the order or obligations imposed by law.
11. Privacy
We handle personal information and customer files in accordance with our Privacy Policy.
Please provide only information necessary for your enquiry or order. Contact us before sending particularly sensitive or confidential materials so we can discuss suitable handling arrangements.
12. Legal rights and resolving concerns
Nothing in these Terms excludes, restricts or modifies any rights or remedies under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or other applicable law that cannot lawfully be excluded.
Purchasing for a business does not, by itself, establish that every statutory protection has been excluded.
Any separately negotiated business-to-business limitation or exclusion must be recorded in writing and comply with applicable law.
If you have a concern, please contact us so we can attempt to resolve it fairly. You remain entitled to seek independent advice or use dispute resolution processes available by law.
These Terms are governed by New Zealand law.
13. Updates to these Terms
We may update these Terms for future orders.
The version provided before you confirm your order applies to that order, unless we agree to a lawful variation in writing.
Updates to the Price Beat Promise will not retrospectively remove qualifying requests submitted while the relevant promise was in effect or valid written quotes already issued.
